Verbazo Terms of Use
1. Acceptance of These Terms
These Terms of Use ("Terms") are a legal agreement between you and Outrun Cyber Dynamics LLC ("Outrun", "we", "us", "our"), the maker of the Verbazo mobile application ("Verbazo" or the "app"). By downloading, installing, or using Verbazo, you agree to these Terms. If you do not agree, do not use the app.
Our Privacy Policy, available at the link inside the app and on our website, explains how the app handles data and is incorporated into these Terms by reference.
2. The Service
Verbazo is a Spanish verb conjugation training app. It offers conjugation reference tables, practice drills, an adaptive placement test, spaced-repetition review, progress statistics, and optional local review reminders. Verbazo requires no account and no sign-up; your learning data is stored on your device (see Section 10 regarding optional analytics), and deleting the app deletes that data. Core features work offline.
Verbazo is an educational tool. It is provided for personal language learning and does not constitute professional instruction, certification, or an official assessment of language proficiency (the app's CEFR-aligned levels are informal estimates, not certificates).
3. Eligibility
You must be old enough to form a binding contract in your place of residence to accept these Terms yourself. If you are a minor, a parent or legal guardian must review and accept these Terms on your behalf and is responsible for your use of the app.
4. License to Use the App
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Verbazo on devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the usage rules of the app store you downloaded it from (the Apple Media Services Terms or the Google Play Terms of Service, as applicable).
You may not, except where the law expressly permits it despite this restriction:
- copy, modify, translate, or create derivative works of the app;
- reverse engineer, decompile, or disassemble the app;
- extract, scrape, or redistribute the app's content or databases (including the conjugation data) outside the app;
- rent, lease, sell, sublicense, or otherwise transfer the app or your license to anyone else;
- remove or alter any proprietary notices in the app.
5. Subscriptions and Purchases
Parts of Verbazo may require a paid subscription ("Verbazo Pro"). Where offered, the following applies:
- Plans and prices. Verbazo Pro is offered as an auto-renewing subscription (for example, monthly or yearly). The available plans, the price in your local currency, the subscription length, and any introductory or free-trial offer are always shown in the app before you buy. Prices may vary by region and are confirmed at the point of purchase.
- Billing. Payment is charged to your Apple App Store or Google Play account when you confirm the purchase. We never receive or store your payment details.
- Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless cancelled at least 24 hours before the end of the current period.
- How to cancel. You can cancel anytime in your store account settings: on iOS, Settings → your Apple Account → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions. Deleting the app does not cancel a subscription. Cancellation takes effect at the end of the current billing period; you keep access until then.
- Free trials. If a free trial is offered, its length and terms are shown before you start. Unless you cancel before the trial ends, the subscription begins and the fee is charged automatically. Any unused trial period is forfeited when you purchase a subscription, where the store's rules so provide.
- Price changes. If a subscription price changes, the change applies no earlier than your next renewal, and the store will notify you as its rules require. Where the store requires your consent to a price increase, the increase will not apply without it.
6. Refunds
Purchases are processed by Apple or Google, and refunds are governed by their policies. To request a refund, contact Apple (reportaproblem.apple.com) or Google Play support. We cannot issue refunds directly for store-processed purchases, though nothing in this section limits any statutory refund or withdrawal rights you have under the law of your country.
7. Restore Purchases
An active subscription is tied to your app-store account and can be restored on any device signed in to that account using Restore purchases in the app's Settings.
8. Intellectual Property
The app — including its software, design, user interface, graphics, icons, sounds, text, and the selection, arrangement, and presentation of its content — is owned by Outrun or its licensors and is protected by copyright and other intellectual-property laws. Verbazo's conjugation content is curated, structured, and presented by us. These Terms grant you only the license described in Section 4; no other rights are granted or implied. "Verbazo" and the Verbazo logo are trademarks of Outrun Cyber Dynamics LLC.
9. Acceptable Use
You agree not to:
- use the app for any unlawful purpose or in violation of these Terms;
- interfere with, disrupt, or attempt to gain unauthorized access to the app or the systems of our service providers;
- circumvent, disable, or tamper with any feature of the app, including purchase entitlements;
- use automated means to access, scrape, or extract content from the app;
- misrepresent the app or its content as your own work.
10. Privacy
Our Privacy Policy describes what little data the app handles: no account, learning data stored only on your device, and optional pseudonymous analytics that you can switch off at any time in Settings → Share usage analytics. Please read it — it is part of your agreement with us.
11. Notifications
With your permission, Verbazo schedules local reminders on your device when verb forms are due for review. These are generated entirely on your device. You can control them through the system notification permission and the reminder-window settings in the app.
12. Changes to the App and These Terms
We are continuously improving Verbazo and may add, change, or remove features and content at any time. We may also update these Terms, for example when the app gains new features or the law requires it. When we make material changes, we will update the effective date above and give you reasonable notice — in the app, in the app-store release notes, or both — before the changes take effect. Changes apply prospectively. If you continue using the app after a change takes effect, the updated Terms apply; if you do not agree with a change, your remedy is to stop using the app and cancel any subscription.
13. Termination
These Terms remain in effect while you use the app. You may end them at any time by deleting the app (and cancelling any active subscription per Section 5). We may suspend or terminate your license if you materially breach these Terms. Upon termination, the license in Section 4 ends; Sections 8 and 14–20 survive. Termination does not entitle you to a refund of store-processed purchases except as provided by the store's policies or applicable law.
14. Disclaimers
The app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing:
- We do not warrant that the app will be uninterrupted, error-free, or secure, or that defects will be corrected.
- The app's educational content is curated with care but may contain errors or regional variations; it should not be relied upon as an authoritative linguistic reference.
- We make no promises about learning outcomes or proficiency levels.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms excludes warranties or consumer guarantees that cannot be excluded under the law of your country of residence.
15. Limitation of Liability
To the maximum extent permitted by law, Outrun Cyber Dynamics LLC and its members, officers, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to the app or these Terms, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the app is limited to the greater of (a) the amounts you paid for the app or subscriptions in the twelve (12) months before the event giving rise to the claim and (b) US $50.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for fraud or for death or personal injury caused by negligence, or your non-waivable rights as a consumer.
16. Apple-Specific Terms
If you obtained Verbazo from the Apple App Store, the following also applies:
- These Terms are between you and Outrun Cyber Dynamics LLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content.
- The license in Section 4 is limited to use of the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (except that the app may be accessed by other accounts via Family Sharing or volume purchasing, where available).
- We, not Apple, are solely responsible for providing any maintenance and support for the app, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support for the app.
- In the event of the app's failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app; any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including (i) product-liability claims, (ii) claims that the app fails to conform to a legal or regulatory requirement, and (iii) claims under consumer-protection, privacy, or similar legislation.
- If a third party claims the app infringes its intellectual-property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the app (for example, your wireless data agreement).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Google Play–Specific Terms
If you obtained Verbazo from Google Play, your use of the app must also comply with the Google Play Terms of Service. These Terms are between you and Outrun Cyber Dynamics LLC only; Google LLC is not a party to them and is not responsible for the app or its content, or for providing support for it. In the event of any conflict between these Terms and the Google Play Terms of Service regarding your purchase or refund of the app through Google Play, the Google Play Terms of Service govern that purchase or refund.
18. Export Compliance and Legal Use
You must comply with all applicable laws when using the app, including U.S. export-control and sanctions laws. You may not use or export the app except as authorized by U.S. law and the laws of the jurisdiction where you obtained it.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the app that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction — except that if you are a consumer resident in a jurisdiction whose law grants you the right to sue or be sued in your local courts or to the protection of its mandatory consumer-protection rules, nothing in this section takes those rights away.

20. Severability, Waiver, and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be enforced to the maximum extent permissible. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and the applicable app-store terms, are the entire agreement between you and us regarding the app and supersede any prior agreements on that subject. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, provided your rights are not reduced.
